This policy statement sets out the manner in which Dataswyft Ltd and its associated companies (“Dataswyft”) deals with intellectual property rights (“IPRs”). IPR includes without limitation patent rights, trademarks, and service marks, domain names, copyright (including copyright in software), design patents, database rights, rights in trade secrets and other confidential information, and rights in IP–related agreements.

Dataswyft invests significant amounts of engineering and financial resources into developing its products and processes. As a result, Dataswyft takes the resultant IPR seriously. Dataswyft IPRs provide significant market and technological advantages. The company is committed to preserving and enhancing its competitive position through strategic IPR portfolio management and will always afford proper attention to identifying, capturing, protecting, and exploiting IP and avoiding infringement of the IP rights of others.

The Dataswyft IPR portfolio is under the management of Dr. Justin Hill at Dentons. Dr. Hill has been recognized by all leading independent legal directories as one of a select number of Leaders in Intellectual Property. He has extensive experience coordinating global IPR strategies for leading technology companies.

Our patent rights include USPTO Patent No. 12,197,454 “Method of Provisioning a Database Server” issued on the 14 Jan 2025 by the US patent and trademark office. This patent underpins our proprietary data account storage and data wallet service, (such as CheckD) built on the open-sourced HAT Microserver.

Our patent rights also include International Patent Application No. PCT/GB2021/051484 "Personal data management platform".

Issued and pending patent rights include 83 patent claims directed to for example:

  • Computer-implemented provisioning of personal databases 

  • Computer-implemented methods of operating personal databases

  • Computer-implemented methods of controlling access to personal databases

  • Computer-implemented methods of performing transactions according to personal database constraints

  • Computer-implemented methods of operating applications for use in connection with personal databases

  • Scalable computing infrastructure comprising multiple instances of personal databases

  • Computer apparatus for implementing the above technologies

Dataswyft reserves its patent rights internationally through PCT, USPTO and other national patent filings globally. Dataswyft is also the owner of further IPRs that protect its products, processes, software, websites, designs, trading style, technologies, and other valuable business assets including, but not limited to trademark rights, rights in passing off and unfair competition, trade secrets, database rights, design rights, and copyrights.

The unauthorized use of Dataswyft IPR damages our business and our partners, and the industry as a whole. Dataswyft respects the IPR of others and expects others to respect its rights in return.

Licensing

Dataswyft may, from time to time, consider entering into licensing arrangements. However, it should be understood that (1) every situation is unique and may not warrant a license at all or may warrant terms that differ from those offered with regard to other IPR, and (2) Dataswyft only grants licenses in writing. Under no circumstances shall licenses or other transactions involving Dataswyft be understood to convey any "implied" rights not specified in the formal terms and conditions.

Third-Party Rights

It is Dataswyft policy to respect third party IPR and not knowingly infringe any third party IPR. We believe we take appropriate steps to minimize the risk of infringing third party IPR. If a third party is aware of any of their IPR being used in an unauthorized manner in connection with Dataswyft business, they are requested to contact Dr. Justin Hill at Justin.Hill@dentons.com who will investigate the situation. Dataswyft reserves the right unilaterally to suspend relevant activities.
